Terms of Service

Effective: April 13, 2026

Welcome to Calda. These Terms of Service ("Terms") govern your use of the Calda mobile application ("App") and related services provided by Blackhole Software, LLC ("we," "us," or "our"). By downloading, installing, or using Calda, you agree to these Terms. If you don't agree, please don't use the App.

We've done our best to keep this readable and fair. If something doesn't make sense, reach out to us at legal@caldalife.com.

1. Your Account

Calda can be used without an account for core features like symptom tracking and medication management. An account is only required to participate in the Calda Community.

  • Sign-in method: Calda uses Apple Sign-In exclusively. We do not offer email/password registration.
  • Age requirement: You must be at least 18 years old to use Calda.
  • One account per person: Each person may maintain only one Calda account. Creating multiple accounts to circumvent restrictions or moderation decisions is not allowed.
  • Account security: You are responsible for maintaining the security of your Apple ID and, by extension, your Calda account.

2. Subscriptions & Payments

Calda offers both free and premium tiers. Core features including symptom tracking, medication management, and the Today dashboard are free forever.

  • Premium pricing: $9.99/month or $79.99/year.
  • Free trial: New subscribers receive a 7-day free trial. You will not be charged during the trial period. If you cancel before the trial ends, you will not be charged.
  • Billing: All payments are processed through Apple's In-App Purchase system. We do not collect or store your payment information.
  • Auto-renewal: Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date.
  • How to cancel: You can manage or cancel your subscription at any time through your Apple ID subscription settings. Open Settings > [your name] > Subscriptions on your iPhone.
  • Refunds: All purchases are made through Apple and are subject to Apple's refund policies. To request a refund, visit reportaproblem.apple.com.

3. Acceptable Use

Calda is a supportive space. When using the App, especially the Community features, you agree not to:

  • Provide medical advice: Share your experiences freely, but do not diagnose conditions, prescribe treatments, or present yourself as a medical professional unless you are one.
  • Harass or bully: No personal attacks, threats, intimidation, or targeting of other users.
  • Spam or self-promote: No unsolicited promotions, advertisements, or commercial content.
  • Impersonate others: Do not pretend to be another person, healthcare provider, or organization.
  • Share dangerous content: No content that could encourage harmful health practices, dangerous self-treatment, or avoidance of necessary medical care.

4. User-Generated Content

When you post in the Calda Community, here's how content ownership works:

  • You own your content. Anything you write, share, or post remains yours.
  • License to display: By posting content, you grant Calda a non-exclusive, royalty-free license to display, distribute, and store your content within the App for the purpose of operating the Community.
  • Content removal: We reserve the right to remove any content that violates these Terms or our Community Guidelines, at our sole discretion.
  • AI moderation: All community posts are reviewed by AI moderation systems before being published. This helps us maintain a safe and supportive environment. Flagged content may be held for review or removed automatically.

5. Health Disclaimer

This is important. Please read it carefully.

  • Calda provides wellness information only. It is not a medical device and does not provide medical advice, diagnosis, or treatment.
  • The App and its content, including AI-generated insights, are not approved or evaluated by the FDA or any other regulatory body.
  • Nothing in Calda should replace the advice of your doctor, gynecologist, endocrinologist, or other qualified healthcare provider.
  • Always consult your healthcare provider before making changes to your medications, hormone therapy, supplements, or wellness routines.
  • We are not liable for any health decisions you make based on information or data provided by the App.
  • If you are experiencing a medical emergency, call your local emergency number immediately.

6. Intellectual Property

The Calda App, including its design, code, text, graphics, logos, and all other content (excluding user-generated content), is the property of Blackhole Software, LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on any part of the App without our written permission.

7. Limitation of Liability

To the maximum extent permitted by law:

  • Calda is provided "as is" and "as available" without warranties of any kind, express or implied.
  • We make no warranties regarding health outcomes, symptom improvement, or the accuracy of AI-generated insights.
  • Blackhole Software, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
  • Our total liability to you for any claims arising from or related to the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

8. Account Termination

  • By us: We may suspend or terminate your account if you violate these Terms, our Community Guidelines, or engage in behavior that harms other users or the integrity of the App. We will make reasonable efforts to notify you, except in cases of severe or repeated violations.
  • By you: You can delete your account at any time from within the App. Account deletion removes your community profile and posts. Your on-device health data remains on your device and is not affected by account deletion.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

10. Dispute Resolution

We believe most issues can be resolved through honest conversation. If you have a dispute with us:

  • Step 1: Contact us at legal@caldalife.com and describe the issue. We commit to responding within 15 business days.
  • Step 2: We'll work together in good faith to reach a resolution.
  • Step 3: If we can't resolve it informally within 60 days, either party may pursue formal legal remedies under the governing law described above.

11. Changes to These Terms

We may update these Terms from time to time. When we do:

  • We will notify you through the App or via email.
  • The updated Terms will include a new "Effective" date at the top.
  • Your continued use of Calda after the changes take effect constitutes your acceptance of the revised Terms.
  • If you disagree with the changes, you may stop using the App and delete your account.
